Clumsy Carpenter Worries Me.


Greetings to all,
I have a carpenter that works for me who is always stumbling, tripping, falling off ladders and smashing fingers. He has never injured himself too badly, YET.
I am worried that the next time could be the ...BIG ONE.
Our work will always be dangerous to a degree. Can I let him go? What does the law say?

Any input would be appreciated. I am new at this employer job.

Write him up on each occasion. After the third incident, you can let him go. Just lay him off, say there isn't any work for him. He will be able to collect unemployment if you are set up legally, but he won't be there for the big one to happen.

I'm clumsy as hell myself, many ladder falls and a lot of blood loss. other than my one allowed finger tip cut off twenty years ago, no hospital visits, no claims.
If he does good work and sucks it up and goes back to work, better keep him. I'd rather give a man a half day off to heal befoe tommorrow, than the whole day due to a hang over.
If your naturally clumsy, then ya gotta be TUFF

California is an 'At-Will' State, no reason needed, write him up a few times to make a paper trail and let him go

Charlie, I think you already have the answer. There is no perfect answer! You are a compassionate guy, telling just by your response. That being the case, you are in a "Work at will" state and you really don't need a reason. If he is doing a good job otherwise, pull him aside and ask him what his problem is. Tell him unconditionally that if he doesn't tighten, he's gone! Alert him that you have a problem and that it is up to him to correct it and if not, he needs to looks elsewhere.

You are the boss and do the hiring and firing. If you feel like he is a liability, it is time to cut him loose.
