Disclosure Forms?


We are a paint and floor covering retailer and recently we've decided to pretty much drop the majority of our yellow page advertising. We'll have just a bold name in there instead of flashy color ads. So now we are thinking about making our own small publication. Kind of an in store magazine for small scale targeted distribution. We'd like to feature photos of a few jobs the local painters have done in our area with our products. I'm sure there are bound to be ownership issues so I'm thinking we'd probably need to have a disclosure formed singed by the customers that participate. Anyone have any experience with this and could you give me some insight on a standard disclosure form to use such photos? Any help is appreciated.

Include it as part of your contractor agreement.

Use photos that don't identify what job is what.

Offer to give credit to the installation company for use of their photo "Photo provided by XYZ coatings."

When I did websites years ago, I had one of my customers, who ran a fishing lodge and had photos of all the top catches of the year, make his customers sign a disclosure agreement so I didn't get sued for using their image. it was pretty straight forward, only a few sentances, and said basically... "I _____ acknowledge that the phot of my image taken at *** Fishing Lodge will be used for marketing purposes by *** Fishing Lodge. I agree this photo will cease use on any future marketing media upon my written request." basically crap to that effect from the top of my head.

I've done allot of this in the past with video and photography. It's called a Model Release Form. Basically it says they give you permission to use their image in any manner you choose for as much money or none, for as long as you want.

Although I'm not sure about photos of inanimate objects like rooms or furniture, you could and should use it just to be safe. Here are a couple quick links I found on the subject and a few release forms you can cut and paste and insert the words that work best for you.

Grumpy's got it right. Just bury the language in the contract and never mention it. And never identify whose homes the pictures are from.
