Pricing And Collusion


Folks, I love this place, and would hate to see any of us get into trouble we didn't intend to.

Having said that, I would recommend that comparisons of job pricing etc, would be better left in the realm of make believe.

Price fixing is against the law, although, some days, when I buy gasoline, I find it damned hard to believe. When we discuss the specifics of pricing, some may interpret that as an intent to set prices for our industry.

Take care in your posts and always remember that what you meant to say, and what you said, are subject to the prosecutorial opinions of "Them-that-must-be-retained", i.e., the lawyers.

In other words, Big Brother is most likely listening. I'd hate for him to get the idea we're anything other than what we are; hard working, tax paying, business leaders trying to learn how to stay on the right side of ten thousand rules and regulations and still provide for our clients, communities, and families.

I think this topic was discussed once before. If someone construes any of the advice around here to be price fixing they have serious mental issues. Don't get me wrong, I know that it's possible someone could contort our words to seem like that's what may be happening in order to bring a frivilous law suit.

As far as what we say being subject to "prosecutorial opinions" you are right...and they would be nothing more than opinions.

It's funny how few things one can actually talk about out loud in a "free" country such as ours.........

The gas deal.....that's legal price gouging that could be considered sanctioned by our govt. Large corporations rights are put before the individual. Small companies like most here are subject to the will of the powers that be....we don't make large enough "contributions" to anybody's campaigns.

You got it wrong price fixing is only against the law for those who do not make campaign contributions this is why pharma and oil co's can do this. it is not lawyers per se it is the same old thing $$ talks and BS walks. Price fixing is not really possible in this feild except in major contracts

D-A, This has been discussed before. Think for a moment and you will realise that price fixing through a BB is impossible.

Believe me! If I imagined that I could create a universal price that would apply to all on this board and be acceptable to customers everywhere, I'd work until I dropped everyday for just a small piece of the action. It's impossible and always will be.

Yes, I raised the issue after I found this site and read some post history, but since then what I have seen is pretty innocuous. As evidence in a case brought from other sources, there could be an issue, but it is pretty much self regulated on this site. It IS still an important issue, though.

Ts, I could POSSIBLY see a small regional area using the BB for price fixing but what are the odds of that happening? It would take the majority of businesses, in a given field, in a specific area to make it happen. Highly unlikely on this BB at this time.

Price fixing is not possible in the construction Business.(unless your Haliburton) There's always someone willing to do the job for free.
When you only have 8 oil company's, price fixing is possible.
When you have millions of hungry contractors, it's impossible.
I do agree that big brother is in our lives more than ever now.

Yeah, Teetor, it is not likely, but it is possible. As I said, there is nothing that goes on this site that could be construed as price fixing, in and of itself, but as evidentiary proof for things that take place outside of the board, there is always the possibility.

You have to realize the low threshold required, and the fact that inference is implied in almost all price fixing prosecutions.

price book???? i didn't get no price book. i feel left out.

i think if everyone will agree to an extra $100/day bump across the board then i may be able to take a vacation. i figure $100 a day wont hurt most homeowners since most of them are financing it and then gettting a tax break on the interest. also, if all of us bump at the same time then ho's can't say any one contractor is cheating them. doctors, lawyers, insurers and carsalesmen are doing it so why not the folks that make it possible for them to live and work.

so how about it???

I'd like to do as the local utility companies do. Raise all my prices due to increases in raw materials, then turn around and show record profits each quarter.

Hey, I thought they only did that here! Raised prices 40% and had a 25% increase in net profits here. Who would have thought?

hmmm... doing some simple math 40% increase minus 25% extra profits means maybe they really only need to raise prices 15%? hmmmmm... verrrrrrrrrrrry interestingk.
