Lawyer On The Prowl


Just heard an interesting story today.

A local roofer was summoned to court because of the Contract Requirements for the State of Ct.
Two years ago he contracted a roofing job,completed it,got paid by the owner and went on his way.

The HO dies,his estate is being looked over by his lawyer who discovers that there wasn't a start or completion date on the two year old contract.

Contractor goes to his lawyer who recommends that he offer the lawyer of the estate $1000.00 to stop the proceedings because it will cost him more to fight it.
Contractor agreed and paid the lawyer.

WTF,
It's got to be greed on the lawyers part since the HO was happy with the work,and there were never any problems with the roof.
Just another reason to cross your T's and dot your I's.!!!

Let them try to take it to court. So many people are too afraid of lawyers. They **** just like everyone else.

I would think about counter suing & going after his license, basis for claim - frivolous lawsuit

Would this fall under blackmail?

It almost sounds like blackmail on the lawyers part.
I'm not even sure the law for the stipulation of a start and finish date was even in force then.It seems my lawyer told me about it last year when he was updating my contracts.

Maybe both lawyers got a cut!

Has to be more to the story....the lawyer could not sue over a contract he had no part in, and the HO didn't initiate the action by the lawyer....no way.

Ethics are supposed to bar an attorney from bringing up actions in just such a manner that clearly only penalizes the opposing party, without due cause.

Had I been that roofing contractor, I would have informed him that my fee for not turning him into the local bar association was a minimum of $10,000.00

I got this story second hand,but talk to that roofer often,so I'll ask him some specifics about what actually incurred.
I do remember the roofer telling me a story of how he sued the Town because they over assessed his home.He said it cost him a few thousand to save a few hundred in taxes.Don't figure,
He said he did it for principle alone.Maybe he just likes to pay lawyers?!?

1. The weather can play a factor in certain aspects of completion and as per state law we are required to present a start/finish date with each contract, in this case I am going to present a estimated work schedule of seven weeks.

That's the clause I use in my contracts to avoid the start and finish dates...and it's legal
