I've never used the stuff, but I can see how many others here have.
It's killed 2 people and made dozens sick. But than again it's on CNN so take it with a grain...

Home Depot is getting sued, along with the manufacturing company, for many cases of harm done by that cr*p.

I took a close look at that stuff after our bathroom tile job and decided it was too good to be true. Think about it - it's aerosol. How is that going to get into the grout well enough to form a seal?

Home Depot was negligent in getting this stuff off the shelves. They deserve to get sued.

How can you sue the retailer in any manner because they sold this product?

If you did a kitchen remodel and the new dishwasher caught on fire because of a "manufacturer defect" after you were done, the homeowner then decides to sue you...

Would you be in the homeowners corner on that one?

I'm not a hundred percent sure but I beleive they are being sued because warnings went out against the product and Home Depot failed to pull it off the shelves.

There have been a number of instances where recalls have gone out and large box stores have failed to pull the product or batches.

Because we have too many starving lawyers who will pretty much file a lawsuit for anything. If you file enough suits, you are going to get a certain percentage of product manufacturers or their insurance companies who will happily settle for some amount just to make you go away. It is strictly a financial decision for them. If they figure it is going to cost them $100K to defend the case in court and risk the possibility of some group of brain dead jurors giving a big award because of their "get even the big company" mentality, they are more than happy to settle for $50k and cut their losses. It is good economics for them, but it just fuels the feeding frenzy of crap lawsuits.

Some of the older plumbers may remember a case about 15 years ago in which some woman put her infant in the sink or lavatory to bath it, and then left the room. A sibling a couple of years older came in and turned on the hot water faucet, and resulted in the infant being severly scalded and disfigured. Everyone but Santa Claus was named in the suit. The owner of the apartment building, the plumber who had last changed out the water heater, the heater manufacturer, the manufacturers of each individual component of the heater (gas valve, burner,pressure relief valve, etc.), the faucet manufacturer and even the local gas company. The result was a several million dollar collaberative settlement because their attorneys all agreed that they would loose much more if they went to trial to defend themselves, even though non of them were obviously at fault, and this
disfigured child was put before a jury.

I don't agree. How is a consumer supposed to know that a product should have been pulled off the shelves? Where Home Depot got the notice that the product had been pulled and failed to act on that notice. That's negligence.

Again, it's all about foresight, you have to cover your own butt so someone else can't walk all over it. I've noticed for years people don't have common sense anymore. My reasoning for this is "Play stupid" win a million. This is why in a small city as Gainesville (Pop. 100k) there are 78 pages of lawyers......

Because that's the heart of the lawsuits. Seems there were quite a few warnings and internal memos that nobody acted on. The product was actually recalled and Home Depot did nothing.

If for no other reason its because HD will sell anything to any idiot who walks in the door. I'm surprised there are not a lot more lawsuits particularly from selling electrical supplies. Or maybe we just don't hear about them.

Its one thing for a supply house or wholesale supplier to sell to the trade. There is at least a good chance the purchaser is going to know how to use the equipment or material and do it safely. But when you make it easy for anybody to purchase materials or equipment that are potentially hazardous if not used or installed a certain way, and you know its not likely the purchaser is going to have that specialized knowledge, there has to be liability when someone gets hurt.

I'm not an attorney but as an EC I do cringe when I see some clueless yuppie asking the brain dead HD electrical department guy questions then buying electrical supplies.

You wouldn't last a second in a court of law, the sharks would have you as an apetizer

Lets face it. Both the manufacturer and HD want to protect thier bottom line. So even though the product was recalled many people were exposed unnecessarily. You can't expect somebody to check every product they buy for a recall.

But at the same time the agency watching all this stuff is under staffed and ill funded to allow them to properly investigate and follow though with incidences.

Finally, there are a number of products that require special knowledge/handling that just any joe blow can use but fail to take proper safety measures. A good half-mask with cheical filters would likely have prevented the incidences (not that I know if this was recomended).

Earlier this year my neighbor decided to to epoxy his garage floor after he saw mine and liked what he saw. I told him to let me know when he wanted to do it and I would lend him some equipment, and a hand if I could.

I came home one day to find him half way through the job, but outside panting. I asked him if he was okay and he said the fumes were pretty bad but as long as he took a break outside every 5-10 minutes he seamed fine. I asked where the directions were if he had read the safety precautions. He said no (he then showed me he was using them for under the paint can as a drip catch). I basically told him he was an idiot. Went and got him an extra half mask with carbon filters. Did a quick field fit test and then went over and gave him a hand.

Lets face some peopl are just not smart about safety. We are after all indestructable and it won't happen to me just other people.
