Father, Son Contractor Law
I've been looking for laws about a son using a father's license in california but I haven't been able to find anything. Can anyone give me a point in the right direction? I want to get this issue straightened out when a father, son work together and when a son does jobs alone. thank you very much for your help.

A hickory stick is not the answer. He does good, consciencious work but is having problems with a side job. (lady likes to fight) Is a father at risk with a son doing side work over $500? Especially when father/son work together most of the time...I thought the father's license covered the son???

I would think the key words in your statement would be "side job". I'm not sure about the laws in california but who pulled the permit? Why would he be under your license when he is doing his own "side jobs". I know that where I am the owner of the company is the only one who needs a license to pull permits and other stuff. The employees can work for him on his jobs. His license does not cover any work the employees may do after hours or on their own. Is the contract with this lady and your son or this lady and you? With the details giving(maybe I'm missing something) it sounds like your son is working without a license. Not sure about cali but there was a thread on here a while ago about people in florida not paying for work done and the contractor couldn't even sue them if they weren't licensed. Good luck

What was your son's "understanding" with the h.o.? Did he represent himself as a contractor, but used your license? Is there a written contract? If he is contracting jobs under your license with your knowledge you are liable for the work, not to mention the possibility of running afoul of the laws of aiding and abetting an unlicensed contractor. Is he named as partner/officer on your license in some way? Registered as a Home Improvement Salesman? |

There are some advantages to a Contractor using family members as employees but using Dad's license is not one of them.

I would think that unless son is a partner (corp, llc, etc..) than he would simply be an employee.

The poor kid is probably over worked and underpaid, so he is trying to do extra work on the side under his old mans license. The father is afraid that the kid will branch out, so now he is looking for legal way to stop his kid from doing the work, knowing he cannot get his own license right now.
