Did The Check Really Clear, Need Your Input?


Started doing work for GC in college station, received a check (draw) for $1000 after 2 weeks of work, right before cashing it, he said not to because he was going to western union the money instead, so I held onto the check. He kept giving me draws but they took longer to come. The job was for 20k, two months of work. He ended up paying 12k, but suddenly disappeared. He never paid me the 8k. That's when I remembered I had the check. I tried cashing it at the bank, but had insufficient funds. After several tries, I just decided to deposit it yesterday. Just now, I took a look at my bank account and it says the check cleared.


My question is; how can that be if he has no funds and we have the same bank (bank of America)?

I would wait ten days just to make sure. And call the bank

Simple.

He made a deposit since the last few times you tried cashing it.

Also, you should always make a copy of every check you receive, so that if you have to sue somebody, it is easier to track down their accounts to slap a judgement against.

I'm thinking of waiting 3 days to see if it really cleared, since the check from the same bank as mine.


Do you think that they just pulled the amount out of his account and now he has overdrawn?

Don't so anything with that "money" yet. I've had checks "clear" and a few days later they zapped that money right back out. Some banks will put it in your account like it cleared after a certain amount of time if things haven't gone through the works officially yet as a courtesy.

I don't think so.

I tried cashing it 2 months ago, then 1 month ago, then just one week and a half ago.

Bank of America is the single worst bank. They will "clear" a check based upon your withdrawal history and your ADB (Average Daily Balance).

See what your "available balance" is.

Do not call or make ANY inquiries. No need to raise flags.

You will know within 10 days.

i disagree, better to raise flags now than 2 months down the road when the bank says they messed up. Then you have to pay it back.

Do NOT spend the money, it ain't yours yet, it should be, but it ain't. Tell the bank what is going on if you're in a fuss for the cash, they'll let you know, otherwise wait.

Next time you get a check you are not sure about, get cash or a certified check or money order. You cash the check, get your cash and walk to the next window and put the money in your account.

I had a B of A account, and closed it . B of A must be the worst bank in the world.

Ditto, I got a letter marked "urgent, regarding your credit report" in a thick red strip across the envelope...frantically opened it thinking I'd been subject to identity theft.
It was a sales pitch on some type of insurance for credit.
I walked in the next day, withdrew my money, closed the account and informed them why.
It's one thing to get a sleazy phone call from an anonymous telemarketer, another altogether when a trusted financial institution tries to sleaze my attention.

As far as not being able to cash it, then being able to, maybe it was timing. If he's going broke he may be juggling with his register-just depositing enough to cover checks he knows are there. He probably considers your check voided so he doesn;t account for it and maybe you just got lucky.

Or maybe the bank credited your account. If it does bounce, they will yank it back from your account.

Most banks will allow you to call and inquire if there is enough money in the account to cover the check. But get there ASAP to cash it.

Last year that happened to me, with my paycheck. To make matters worse I had paid bills and wound up in the negative with overdraft charges, I wait now.

Simple withdraw all your money including the funds in question. Put that cash in a safe place until the smoke clears. If it turns out that the check is bad then just simply walk away from the account and bank somewhere else. Let the bank prosecute the bad check writer for you.
