Broke My Ankle

Greetings to all
just broke my ankle on the job site .I'm a dry waller(piecework) here in Toronto.member of 675. and have some insurance from penncorp , and hopefully workman composition.
The doctor had to put plate and screw in my ankle .

My question from you guys is what to expect for recovery about my injury, can I go back to being a dry waller .
What about workman composition??
Just sitting at home, using two crouches to walk .

All the best
Jozsef

Re: Broke My Ankle

I guess the question of compensation should be addressed - do you carry your own? what I mean is are you registered with (Ontario) compensation? or if you are working for a GC that has compensation coverage? If so, the compensation folks will probably send someone out to the site to check out the circumstances of your injury. Was something not done? safety rail not in place? things like that can scare GC's because if they haven't been diligent about keeping a safe work site, they can get a nasty fine.
As for recovery, I discovered how long the hard way some years back I broke my arm- fell thru a hole- 23 dec... was the end of April before I was strong enough to go back to work...
learned a huge lesson though- I am slower, more careful, and I will not work on an unsafe site. had some hassles overthat but ultimately it comes down to this: if I don't work, I don't get paid.
good luck, I hope your injury heals soon!

Mac.

P.S. I am registered with comp here in B.C. - costs me 4.9% per 100 bucks earned... its worth it.

Re: Broke My Ankle

I had a fall from a ladder, about 35-40 feet down to the dirt. Landed on my feet. My left foot was completely shattered, and required 7 hours of surgery and 6 temporary pins installed. (Think of the magicians assistant in the box ful of swords.) My right heal was shattered. My left fibula, (shin bone) was broke. My left hand required 3 pins for the multiple fractures.

I was in a wheelchair for a little over 2 months. For the first 6 or 7 years it felt continually as if the breaks had just occurred, then incredibly, it started feeling better. I walk with a limp that other people observe, but I do not realize it myself.

It's all a little stiff in the morning, but a reak hot soak bath and 3 Aleve's seem to compensate just enough. Continuous discomfort when I pay attention to it, but usually it is not noticeable.

As far as Workers Compensation, your employer should have that, which should take care of all of your medical bills and provide an allowance per their scheduled allowances due to the per-centage loss of useability of your injured body parts. If that settlement is not appropriate enough, a lawyer can get them to usually up the ante, but then they get 20 % of the claim as their fee. If you were working self employed and did not have insurance, then the party who employed you may have to cover you. At that point, for sure get the advise of an experienced workers Compensation attorney.

Good Luck and Speedy Recovery,

Ed

Re: Broke My Ankle

Broke mine about 5 years ago. I can move just fine but its not %100. I have to be really carefull when steping down from something or walking on uneven terain. Other than that I just fine. . If I broke a bone now I would be in serious trouble (no work = no pay). Hopefully your employer is a responsible one and you will be ok. Best of luck to you

Re: Broke My Ankle

I had an accident about 4yrs. ago with a bad circular saw. I told the forman that it should be sent back because the guard would stick and I knew someone was going to get hurt and that someone was me. One day I picked it up not knowing it was the bad saw to make a quick cut I set it back down and the guard never came back down so it spun directly across my thumb, almost severing it completely . I had about 8 hrs. of surgery and 5 months of physical therapy workmans comp did cover all of it and payed me almost 3/4 of my weekly rate I was fortunate enogh to have a good surgeon because he made the bend at the tip so I could still swing my hammer with out a wrist strap and so I could continue boxing. O ya 1 plate and 7 screws in my thumb. I hope you have a quick recovery.

All that and you think you are going to need a lawyer? Well, fortunately I am here to tell you to stop thinking and go get yourself a lawyer. Don't wait for these people to start doing the right thing, they aren't going to

Re: Broke My Ankle

You also have the right to seek your own medical opinion from your own Doctor or one that your attorney recomends.

Don't just let them take advantage of your health and be bullied into being forced into returning too early. Stand up for yourself, you broke your ankle, not your backbone.

Get a good attorney, NOW!!!

Their inept attempt at trying to manipulate you to return to "light" duty has now caused an additional injury.

Check out the work comp hearing board and see which firms do significant amounts of representation or ask someone who has gone through the process how adequate they felt their legal aid was.

Ask your personal attorney, if he specializes in WC and also ask him, which other attorney he would recommend to use. Call up several law offices and ask who, besides themselves, that they would recommend and see if their is a common consensus.

Ed

Do it now, for your own sake!

Re: Broke My Ankle

greeting to all

I'm really pissed at the way the government of Canada lets the big companies and corporations dictate the way the WSIB. of this country is run!! I being a victim of a serious ankle fracture, need to had surgery, and hospitalization ,and it looks my claim is going to be denied !!My surgeon told me, and send the forms to WSIB regarding what I can, and cant do, for my recovery, stay home ."not to go to work" and rest ......yestuday I get a call from the judicature, he told me about the denial, and a reson..."If I could go to the doctor appointment (ons) then I cud of go to work" and listen to this!! " Not the doctor paying me" so I should of know it what to do" .I dint be live my ears .I think its about time something was don to correct this CRAP!!Employers and WSIB ruined more people and families for way to long!!Apparently the medical profession in this country HAS NO SAY, OR PULL when it comes to the decision of a persons health and wellbeing when it comes to WSIB..........It dist-oughts me .....IS THIS IS CANADA???? the good ,the best,blah.. blah.. bla... .They have caused me more pain and suffering and going to screw me financially,(mortgage), and causing me family problem, (single father my son 9y old)

So what the hell is this so called government of this country is going to do about this problem???? The dummies they have working at WSIB.are to me.......stupid dummies that SHOULD GET OUT IN THE REAL WORLD AND WORK FOR FOR A LIVING INSTEAD OF MAKING BIG MONEY AND BONUS,AND TAKING OUR LIVING AWAY!

again ,All the best
