Question

Bid War!!!


Helo,
I would like to know what are my options if i lost a bid to an unissured (workmens comp) contractor in a gov/school job???
Here is the down low fo'shiz:
i was bidding this job for a gym in a high school, my bid came in 2nd, the "winner" have no workmens comp ( by the state posting = "exempt" since the day he got his license ) Now ,,,there are a few options :
1) He hire a sub. ok got me on that ..Gee i dont and cant have info on that ,,,he has a right ,,,but how can he outbid me then hire a sub and still turn a profit ( did i mention this is prevailing wage ,bonds,the whole 9 yards) he outbids me by less the 10%.
2) He performs the work himself (litle supermen he is),,, i doubt he can refinish and strip+logo +art work 12K sq.ft by himself...?? which lead me to number....
3) If he has no employees for the past 6 years (since license was issued) where is his experience at doing this job come from???
i need your input if you had a run in in a situation like that, i need to get to the bottom of this ,,, i alredy contested the result and asked the district to review the outcome, so far they are holding thier ground!!!

move on. shi! happens, what makes you think you are the workers comp police? the time you spend trying to prove to them he should not have the job will be better spent finding more work. i do understand your frustration, just know, it will eventually catch up with him.

My advice is different. Fight it by any means at your disposal, but don't invest too much of your own time into it. I presume this was decided by a committee? Maybe speak privately with one or two of them and voice your concerns.

There can't be that many of this sort of job out there that you can let one go too easily

1.) Maybe the guy is a goof?
2.) Maybe he does not have any idea what the heck he is doing, and will end up losing his shirt on this job.

You can't compete with either one of those factors.

Maybe he'll sink his own ship. Let him screw it up and you'll be next on their list. Then you can name your price.

I wouldn't lose any sleep over it. The time spent on it could be used to find more work.

You need to go to his accountant, bribe them to get ahold of his financial records. Okay, now you have evidence! Then you need to hire a detective to do some snooping around. Dig up some dirt on this guy. Have his past clients give the "comity" a call to explain how they were ripped off. Then you can go to the "comity" and tell then to hire you. Just to top it off, you may want to publicly bash him.

Of course there is always the other option in this situation. FORGET ABOUT IT! So what, you lost a job. Deal with it. Is this gonna cripple you?

Got it i will let this go ,,, like the fact that he can choke on it ,,,
However i will let you all know that this guy is NOT playing fair he did it to me today tommorow itl be you and the awarding agency is playing along, how do you fill now?

Don't worry what the other guys say, if you don't agree with their thoughts on this then do whatever you think best. Remember every one here speaks their own opinion and from their own point of view.

You must decide for yourself whether there is any mileage in pursuing this matter. If you are sure the guy really is cheating, and if there is something you can do about it without investing too much time into it, then do it. I would.

Otherwise, move on.

On this and other boards, I've noticed plenty of people who have trouble stringing together thier words coherently. Sometimes I wonder if this is just because they are in a hurry to get their thoughts down on paper, or if they really think this way.
This particular fellow has a bit to learn about spelling and grammar, and perhaps you are correct.

I had thought to mention the disjointery (I made that word up, sort of) in his wording, but I didn't want to come off "holier-than-thou". However, since you beat me to it, I agree.

How do I fill? itl be me tomorrow, eh?I have news for you, IT IS ME TODAY!!! Not just me, but many contractors here. I'm building here in Austin, Texas- do you realize how many jobs I lose to illegal/unregistered Mexican "contractors", who employ illegal labor??? Too many. What do I do? The same thing when I get pulled over for doing 75mph and fools are sailing past doing 82- suck it up and deal with it.
Neolitic has a valid point. It took me some time to decode your text. I hope someone else is writting your proposals, or at least you have someone proof them before they are sent.

It is my belief and my experience that a person(s) who type as they speak just do not have enough experience "thinking-out" that which they desire to communicate.

It is also my observation that often, said people are unaware of the difference or the necessity to be a bit more "formal" or "refined" whilst addressing groups and/or prospects.

Fo'shiz may sound cool "in the hood, on the street or amongst you posse" "G", but this form of grammar is not an acceptable form of communication in the "Real World".

Regional, socio-economic, cultural and educational factors certainly play a part, but please allow me to tell you a story about a good friend of mine.

He is a Black man who grew up in a predominantly White-Upper-Middle-Class, top-90 percent educational factor area in Westchester County, New York (one of the richest Counties in America). His dad was an executive with a Fortune 200 Company. He was driven to School daily in a Jaguar XJSC. His best friend was an Asian, Geek, Bookworm, Harvard-Bound, nice guy. His sister was the President of her class. Adrian spoke well. He got EXCELLENT grades. He was a pleasure to be with. I consider him a good man. When he hung out with the few Black kids that were "bussed" in, he was a complete 180. He became ghetto and wanted to sound cool. It was as if I did not know him. Nor wish to.

My point is this.........Be who you are and do not try to "sound cool". We all fail miserably when we do so. Think a bit before you speak/type and you will excel far beyond the point of where you are today. If you know no other words to complete a sentence, do as my MOTHER would ALWAYS tell me to do when I asked her a definition of a word. LOOK IT UP! (Dictionary/Thesaurus)

You will be amazed at the way people respond. White, Black, Asian. Rich, poor, somewhere in between. It matters not. People respect a well carried, well spoken Man.

When I first got my contractors license I was exempt, and if you visited the contractors board website and searched my license number it said no workmans comp exempt, when I started to hire employees and was issued a workmans comp policy the contractors board was unaware and for many years it stated the i was exempt, maybe the same thing is happening with your competition.
