First off, I agree with Glasshouse, WHY did it fail? That will determine a lot right there. When you determine that, you will know where to go next.

maybe I missed some detail, but the poster didn't say the painter/tile installer did this contractually for the homeowner via the painter. If the contract (written or handshake) was between the homeowner and the part time tile guy, then the painter doesn't see any liability other then recommending someone to do something he shouldn't have.

as for the cracking grout, that could be easily fixed, but cracking tile??? sounds like some serious movement to cause the tile to crack. Additional info is necessary to really help, all though it sounds as if the situation is 'resolved'

have a certified flooring inspector look at the job. It is determined that it is the fault of the installation he should pay ALL cost involved in making the H.O. whole. If it is a problem other than the installation he is off the hook. That is exactly how I have always handled any of my job related problems. In the end if it is your fault step up, if not find out what the problem is and offer some proper and legal solutions to the customer. Either way you have done the responsible thing and can walk with you head high. It is always right to do right. Don't let your morality be dictated by your wallet.

The first thing to do is have a D3P who is skilled in that trade, look over the job and suggest what went wrong.
Only then should the negotiations start as to who is to pay.

cracking tile and grout could be many things. It could be a improper subfloor or wrong type of thinset. But either way it goes back to the person doing the install didn't check out the substrate properly. I licensed tile pro who knows what he is doing will check the floor to see whether or not it is suitable for tile. I know any floor I do I run the specs through a deflecto calculator to make sure the floor is suitable for the tile. It's tough to say who is at fault but to me its the homeowner for hiring an unlicensed tile guy. Maybe he should have hired the painter to paint tiles on the floor not install tilles

Sounds like a good and fair idea. How would you go about hiring one so the client does not think that you are bringing your friend over to side with you? I quess this could work both ways, the client could have their uncle dressed up like a CFI.

If the inspector is certified he/she will have the credentials to back it up. For this much money I would make sure of their certifications first... then let the chips fall where they fall.
